RGP participates and sponsors a conference on best practices in written pleadings in international arbitration

The event was co-organized by the leading organizations for young arbitrators: ICDR Y&I (International Centre for Dispute Resolution Young & International), RAA 40 (Russian Arbitration Association 40) and ICC YAF (International Chamber of Commerce Young Arbitrators Forum). A panel discussion on best practices in written pleadings and their importance for successful dispute resolution in international arbitration was held on 17 September 2019 as a satellite event to the XI annual ABA Conference of the Resolution of CIS-Related Business Disputes.

The discussion was moderated by Yan Kalish, a counsel at RGP’s dispute resolution practice, and Marina Akchurina, an associate at Cleary Gottlieb.

Speakers shared their best practices relating to preparation of written pleadings on various stages of arbitration proceedings. The arbitrators speaking at the event provided their feedback on recommended and, vice versa, best avoided approaches to preparing written pleadings on behalf of the claimants and respondents.

In particular, valuable advice was given on the most efficient ways of promoting the strengths of one’s position and turning seemingly strong points of the opponent’s position to one’s favour. Panel members stressed the importance of clear and simple presentation of information in written pleadings. The speakers also discussed the subtleties of taking into account the cultural differences and different legal systems when working with a specific tribunal, which often brings together arbitrators originating from different countries and law schools.

Yan commented that such events are invaluable as they bring together experts and legal practitioners from various countries to discuss the most relevant practical issues of international arbitration. Over 45 legal practitioners took part in the panel discussion. The event was held at the Moscow office of Baker McKenzie.
